WEBSITE TERMS AND CONDITIONS 

This website is owned and operated by Aelproject.com ( we , us , our ). The following terms and conditions ( Terms ) govern your use of the website and by accessing the website, you agree to accept and be bound by the Terms in full. 

Website content and access 

While we take all reasonable care in preparing, maintaining and updating the information on this website, you acknowledge and accept that the website content may include errors and may not be up to date at the time you access it. The website content is subject to change at our sole discretion without notice. 

Intellectual property 

The materials displayed on this website, including without limitation all editorial materials, information, photographs, illustrations, artwork and other graphic materials, and names, logos and trademarks, are solely our property and may be protected, at our sole discretion, by copyright, trade mark and other intellectual property laws. Any such content may be displayed and printed solely for your personal, non­commercial use, provided that any copyright notice on such a display or page is not removed. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material to any third party without our express prior written consent.

1. REGISTRATION & ENROLMENT

The details provided by you on Registration are important and must be true, correct and complete. You agree to notify us immediately of any changes which are relevant to your registration by updating your online AEL Profile and Account or informing AEL in writing via email or text or standard mail.

2. Personal Information

We will respect your personal information and undertake to comply with all applicable UK Data Protection legislation currently in force. In relation to the personal information provided by you on registration (your registration details) you agree that AEL may use such information in accordance with the purposes for which your permission has been obtained on registration (for example informing teachers and host-family of what is relevant to their tasks in order to provide the best care of the students). Other than as required by law, or as permitted under these user conditions, AEL will not disclose your registration details to any third party without your permission.

3. GENERAL USE OF INTERNET

When using our online services, you must not use our Services:

  1. In any way that is unlawful or illegal or in a way that affects the enjoyment of other users of the Services.
  2. To transmit, publish, link to, make available or receive any material which is defamatory, offensive, abusive, obscene, indecent, racist, harmful, threatening or menacing; or 
  3. In a way that will be a breach of any person\’s rights, including a breach of confidence, copyright, privacy or any other rights; or
  4. In breach of any instructions we have given you under the Agreement; or
  5. In a way that is associated with a criminal offence; or
  6. In a way that does not conform with the acceptable use or anti-spam policies of any connected networks, the standards of the Advertising Standards Authority, professional publishing standards or any Internet standards; or
  7. To infringe by the use of any domain name, mail box name or otherwise upon the rights of any other person in a trade mark or name whether in statute or common law; or
  8. To send email or any other type of electronic message with the intention or result of affecting the performance or functionality of any computer facilities.
  9. To intentionally disrupt or adversely affect any other person or entity\’s access to or use of the Internet or any features which form part of the Internet;
  10. To transmit or cause to be transmitted any advertising, promotional or other materials that are unsolicited (commonly known as “spam\”);
  11. to transmit or cause to be transmitted mail bombs, chain letters or pyramid schemes.

4. GENERAL USE OF ON-SITE SERVICES

While attending our programmes, you must not:

  1. Smoke, use drugs or alcohol in any part of our venues and in any time of lessons or activity programme including outing and excursions or external visits; or
  2. Disrupt any lesson or activity in respect of other participants, staff members and hosts; or
  3. Damage any equipment, material and venues by any means; or
  4. Disrespect, bullying or stalking other students, AEL staff members, hosts or local residents.

PLEASE NOTE: Although the large majority of our students is extremely polite and careful, we need to notify in advance that anyone not following the guidelines set out under this paragraph, will have to compensate us against all claims, demands, actions, costs, expenses (including legal costs and disbursements), losses and damages arising from or incurred as a result of your actions. Furthermore, infringing any of the above guidelines or intentionally not abiding by them may result in AEL refusing enrolment or curtail your stay shorter at your expenses.

Section B

5. PAYMENTS, LIMITATIONS & LIABILITY

BOOKINGS -To book a course you need first to register, then enter your administrative record and select one of the available courses. The access to the administrative area might be denied if we verify that the user provided false information or is in breach of our use of services.

PAYMENTS – 1) After enrolling in a course we ask to pay a deposit of the amount indicated in the invoice. The deposit is non-refundable under any circumstances. If the deposit is not issued within 10 days from the enrolment, the booked place will be released and made available to other students. 2) The balance payment must be received 28 days before the course commences. In case of late bookings all fees are to be paid within the terms indicated in invoice. 

6. CANCELLATION – All cancellation notification must be sent in writing, including by email or text messages. 

  • Cancellation received 28 or more days before a start date: loss of deposit only
  • Cancellation received 15-27 days before a start date: loss of deposit and the equivalent of one week
  • Cancellation received less than 15 days before a start date: no refund is possible.

7. NON-ARRIVAL – In case of non arrival due to illness or other serious circumstances we can only promise to do our best but in principle no refund is available. We strongly advise all students to take out a travel insurance package to cover all circumstances and medical expenses, please see below. 

8. CURTAILMENT OF COURSES – Students cutting short their stay are not entitled to any refund. Once again, please sign up for a full insurance. 

9. REFUND OF FEES – No fees will be refunded after a student has completed their stay. 

10. JOURNEYS – We may organise journeys for our students on request. We do not organise any journeys for unaccompanied minors. We apologise that the costs of the journeys -in case of cancellation- cannot be refunded under any circumstances after the tickets have been paid. To cover this, again, please consider buying travel insurance. 

11. PASSPORTS & VISAS – All passengers entering the UK must have a valid passport. Identity cards -including EU ID cards- are non longer accepted at the UK Borders. No refund is considered if the entry is denied due to invalid passport or invalid or incomplete documentation required by the UK Authorities. Students coming from countries for which a visa is required, must apply in good time and obtain the correct visa. A copy of the passport -and visa if applicable- must be provided to AEL after enrolling and one month before a start date. In case the English Authorities refuse the visa, the student has to inform AEL as soon as possible. No refund of fees can be taken into consideration if the student informs AEL less than 28 days before a start date. Refund of deposit is anyway not considered. This is one more reason that a student applies for the visa in good time.

12. HEALTH AND SAFETY AND MEDICAL TREATMENTS – In case of minor injuries or illnesses experienced by the Student, their parents will be contacted and a qualified practitioner will administer general first aid treatment according to the Parents choices in the Parental Consent form. In the event that Student’s Parents cannot be contacted or if any urgency dictates, AEL manager will act in loco parentis for the Student’s health and safety in respect of any circumstances, including any accident or illness, which may necessitate medical treatment including surgery, and any such treatment or surgery which they, in their sole discretion, (which discretion shall not be unreasonably exercised), may deem necessary. Medical treatment for the Child may also include dental surgery, x-ray, blood transfusion, anaesthetic and medication provided that any such medical treatment is advised and performed by a fully licensed practitioner. The Parents accept full liability for all costs incurred through such medical treatment(s) for the Student. 

13. EXCEPTIONAL CIRCUMSTANCES – No liability can be accepted -and no refund made- for circumstances beyond our control such as war, riot, flood, strikes, accidents, severe travel delays, flight cancellations, contagious diseases, vandalic or criminal actions etc. AEL will be keen to considered alternative options for the students affected, if such an option becomes available.

14. COMPLAINTS PROCEDURE – Students must inform immediately the AEL director or a staff member if they encounter any problems regarding their courses or accommodation. Each complaint will be individually evaluated to match at best the student\’s needs and requirements with reference to the general standards of the student\’s welfare as outlined in the UKCISA and other official documents to protect the wellbeing of International Students.

15. STUDENTS COMMITMENT –  When enrolling in any AEL course, students take the commitment to participate into all the lessons and activities included in our programmes. They also abide by the AEL ethos and policy regarding the respect of every cultural or political background, any religious faith, any gender personal conditions etc. Bullying, racism, damages, antisocial behaviours and discrimination of any kind are not tolerated. In the unfortunate case that a student has to be banned from a course and send home because of the above, the family will be liable for all the expenses, related to the early departure. No refund is obviously taken into consideration. (See also section A.4)

16. TRAVEL & MEDICAL INSURANCE – We strongly recommend all the students to take out a complete insurance package, extended to the dates of travelling and to the time after school. A complete insurance package covers travel insurance, cancellation, loss of money and medical expenses. 

17. BLOG & FORUM – The registered users are enabled to post their contents (articles, photos, clips) under their own responsibility. Users are not enabled to: a) modify or delete contents posted by other users, b) misuse any personal information given in good faith by other users. No personal information given with the registration form will be passed on to third parties by Active English Learning. Users are aware that any content published on the blog becomes readable to everyone and that they grant Active English Learning the license to publish their contents and images: therefore no payment or Intellectual Property rights royalties can be required for the contents posted by users. All the contents posted by the users may be archived after a minimum period of 2 weeks. As registered user of AEL Services, you agree that you will not post any contents that may be malicious, hateful, offensive, threatening or anyway unlawful and that you are fully responsible for the contents posted on the blog. Active English Learning reserves the right to remove any posted content if we believe that it violates the above Terms and Conditions. In no case Active English Learning is responsible for the contents published by the users. (See also section A.3)

FINAL TERMS 

Interference with website 

You must not attempt to change, add, remove, collect data, deface, hack or otherwise interfere with our website or its contents. 

You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any computer virus or other malicious computer software. 

Breaches of these terms and conditions 

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you. 

If you are in breach of the Terms, you hereby indemnify us against any loss, damages, costs, liabilities and expenses (including but not limited to legal expenses) suffered by us as a consequence of any potential or actual breach by you. 

Privacy 

We are committed to the privacy of our customers. Use of this website, registration data and other information about you are subject to our Privacy Policy

AGREEMENT – Registering and enrolling online or via email, phone and by any other means include the acceptance of the above \”Terms and Conditions” as well as our Privacy Policy and the commitment to abide by them.
